This Privacy Policy explains how GigWorx Franchising LLC and its independently owned franchise offices ("GigWorx," "we," "us," or "our") collect, use, share, and protect personal information. It applies when you visit gigworx.com, use the GigWorx mobile app, apply for work, work shifts through GigWorx, hire workers through GigWorx as a client, or receive emails, calls, or text messages from us.

1. Information We Collect

Information you give us

  • Contact information: Name, phone number, email address, mailing address, and communication preferences.
  • Job applicant and worker information: Work history, skills, certifications, availability, preferred locations, references, resume, and interview responses.
  • Employment and payroll information: Because GigWorx is the employer of record for our workers, we collect information needed to hire and pay you, such as Social Security number, date of birth, tax forms, employment eligibility documents, and direct deposit details.
  • Background check information: When you authorize it, we receive background check and screening results from our screening providers.
  • Client information: Business name, contact names, job titles, work site addresses, shift details, and billing information.
  • Account information: Usernames, passwords, and profile details for the GigWorx app.
  • Device and usage information: IP address, browser type, operating system, device identifiers, pages viewed, and how you use our website and app.
  • Location information: When you allow it, the GigWorx app uses your device location to support shift check-in and check-out and to show nearby work.
  • Cookies and similar tools: See Section 6.
  • Review applications, interview candidates, and onboard new workers
  • Match workers with shifts and manage scheduling
  • Process payroll, taxes, and required employment reporting
  • Run background checks when authorized
  • Provide staffing services to clients, including billing and account management

  • Information we collect: Your mobile phone number, the messages you send and receive, and the date, time, and method of your opt-in consent.
  • How we use it: Only to send the messages you agreed to receive, respond to you, and keep a record of your consent and opt-out requests.
  • Consent is optional: You do not have to agree to receive text messages to apply for work, work with GigWorx, or use our services.
  • Opting out: Reply STOP to any message to stop receiving texts. Reply HELP for help, or contact help@gigworx.com or 855-684-0038.
  • Costs: Message and data rates may apply. Message frequency varies.
  • Service providers: Companies that help us run our business, such as payroll, background screening, cloud hosting, CRM, phone and messaging, and analytics providers. They may only use your information to provide services to us.
  • Clients: When you are assigned to a shift, we share the information a client needs, such as your name, role, qualifications, and schedule.
  • GigWorx franchise offices: Information may be shared between GigWorx Franchising LLC and the local franchise office that serves you so we can provide our services.
  • Legal and safety: When required by law, court order, or government request, or to protect the rights, property, or safety of GigWorx, our workers, our clients, or others.
  • Business transfers: If GigWorx is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction.
  • Know what personal information we have about you and get a copy of it
  • Correct inaccurate information
  • Delete your information, subject to legal record-keeping requirements
  • Opt out of targeted advertising, the sale of personal information, and certain profiling
  • Withdraw consent you previously gave, including consent to receive text messages

Information we collect automatically

Information from other sources

We may receive information from background check and screening providers, job boards and recruiting platforms you apply through, references you provide, and clients who share feedback about shifts worked.

3. Text Messaging (SMS)

If you opt in, GigWorx may send you recurring text messages. Workers and applicants may receive messages about job opportunities, shift offers, shift reminders, schedule changes, onboarding, and account updates. Clients may receive messages about shift confirmations, worker assignments, schedule changes, and account updates.

  • Information we collect: Your mobile phone number, the messages you send and receive, and the date, time, and method of your opt-in consent.
  • How we use it: Send the messages you agreed to receive, respond to you, and keep a record of your consent and opt-out requests.
  • Consent is optional: You do not have to agree to receive text messages to apply for work, work with GigWorx, or use our services.

We do not share mobile contact information with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors in support services, such as customer service. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. When and With Whom We Share Information

We do not sell your personal information. We share information only as described below. Text messaging opt-in data and consent are excluded from all of these categories and are never shared with third parties.

5. How Long We Keep Information

We keep personal information only as long as we need it for the purposes in this policy. Some records, such as payroll, tax, and employment records, must be kept for periods set by law, even after your account is closed. When we no longer need information, we delete it or make it anonymous.

 

6. Cookies and Tracking Technologies

Our website uses cookies and similar tools, including Google Analytics and HubSpot, to understand how visitors use the site, remember preferences, and measure the performance of our content. You can block or delete cookies in your browser settings. Some parts of the site may not work properly if cookies are disabled.

Our website does not currently respond to Do Not Track browser signals. Where required by law, we honor Global Privacy Control signals as a request to opt out of targeted advertising.

7. How We Protect Information

We use reasonable administrative, technical, and physical safeguards to protect personal information, including access controls and encryption where appropriate. No system is completely secure, so we cannot guarantee absolute security. Please keep your account password private.

8. Age Requirement

Our services are intended for people 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn we have collected information from someone under 18, we will delete it. If you believe this has happened, contact us at help@gigworx.com.

9. Your Privacy Rights

Depending on where you live, you may have the right to:

  • Know what personal information we have about you and get a copy of it
  • Correct inaccurate information
  • Delete your information, subject to legal record-keeping requirements
  • Opt out of targeted advertising, the sale of personal information, and certain profiling
  • Withdraw consent you previously gave, including consent to receive text messages

Residents of states with consumer privacy laws, including Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Montana, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia, may have additional rights under those laws.

You may use an authorized agent to make a request on your behalf. If we deny your request, you may appeal by replying to our decision, and we will respond within the time required by law. We will not treat you differently for exercising your privacy rights.

You can unsubscribe from marketing emails at any time using the link in the email.

10. Changes to This Policy

We may update this Privacy Policy from time to time. The updated version will be posted on this page with a new "Last Updated" date. If we make significant changes, we may also notify you by email or through our app.
